SOSIALISASI TERHADAP PENARIKAN KEMBALI HIBAH OLEH AHLI WARIS MENURUT KOMPILASI HUKUM ISLAM DI DESA CUT LANGIEN KECAMATAN BANDAR BARU KABUPATEN PIDIE JAYA

Abstract

Hibah merupakan pemberian yang dilakukan secara sukarela atau tanpa adanya paksaan dari siapapun dalam mendekatkan diri kepada Allah SWT tanpa mengharap balasan apa pun. Karena itu, banyak dalil atau nash yang menganjurkannya. Dalam pelaksanaannya banyak hibah yang di tarik atau diambil kembali oleh pihak pemberi hibah dengan berbagai alasan, misalnya si penerima hibah tidak mendaftarkan ataupun membuat surat pembuktian pada saat peristiwa penghibahan  itu terjadi dalam jangka yang cukup lama. Hal ini di ketahui setelah hibah terlaksana dan kedua pelaku pemberi dan penerima sudah meninggal dunia. Tujuan dari kegiatan pengabdian ini adalah untuk membangun kesadaran  masyarakat bahwa hibah tidak boleh di tarik kembali sebagaimana  tercantum pasal 212 Kompilasi Hukum Islam (KHI) menyatakan bahwa penghibahan tidak boleh ditarik melainkan penghibahan orang tua terhadap anknya. Bentuk kegiatannya berupa sosialisasi dengan pemaparan materi menggunakan metode ceramah dan tanya jawab, Kegiatan   ini   terlaksana   karena terwujudnya kerjasama antara seluruh anggota kelompok pengabdian masyarakat dalam menjalankan kegiatan serta dukungan berbagai pihak terutama kepala desa dan warga Desa Cut Langien Kecamatan Bandar Baru Kabupaten Pidie jaya dengan harapan dapat berlanjut di lain kesempatan dengan berbagai program lainnya.

Grants are gifts made voluntarily or without coercion from anyone in getting closer to Allah SWT without expecting anything in return. Therefore, there are many arguments or texts that recommend it. In practice, many grants were withdrawn or taken back by the grantor for various reasons, for example, the recipient of the grant did not register or make a letter of proof when the granting event occurred for a long time. This was known after the grant was implemented and both the giver and recipient had died. The purpose of this community service activity is to build public awareness that grants cannot be withdrawn as stated in article 212 of the Compilation of Islamic Law (KHI) which states that gifts may not be withdrawn but are gifts made by parents to their children. The form of the activity is in the form of socialization by presenting material using the lecture and question and answer method. This activity was carried out due to the realization of cooperation between all members of the community service group in carrying out activities as well as the support of various parties, especially the village head and residents of Cut Langien Village, Bandar Baru District, Pidie Jaya Regency in the hope of being able to continued on another occasion with various other programs.
